The following attachments detail the ownership and land use rights of the meadow property for Rivermoore Park residents.
Attached please find the three agreements (all of which are recorded in the Gwinnett County deed records) addressing the use and ownership plans for the "meadow" area of the Rivermoore Park subdivision.
In order to best get the lay of the land, you should first refer to the Recreational Easement Agreement, in which TPL, as owner of the 76 acre "Parcel B' (which is the Meadow and active recreational area designated next to it), grants an exclusive easement to the developer of Rivermoore Park to use that acreage for recreational purposes for the benefit of the Rivermoore homeowners. The details of how the property can be used, and insurance that must be maintained by the homeowners' association are all covered in this agreement. The references to Parcel A, and easements over Parcel B for the benefit of Parcel A, are all now moot, as that is the riverfront property that is owned by the National Park Service, and thus won't be developed with homes that need to make use of the subdivision amenities. Likewise, the "cut and fill" easement referenced in subsection 1(d) is now moot.
